Scope of Services

This quotation applies only to the commodity, trade lane, delivery terms, weight, volume and other information expressly stated in the quotation.

The Customer is responsible for providing complete and accurate cargo information before booking, including but not limited to:

  • Commodity name, cargo type, packing method, weight and dimensions;
  • HS Code (if available) and cargo composition;
  • MSDS, UN38.3, Dangerous Goods Declaration or other technical documents for dangerous or special cargo.

Any request outside the quoted scope of services will be notified and quoted separately by AMI before execution.

Quotation and Validity

The quotation is valid for the period stated therein.

Rates are based on the tariffs of shipping lines, airlines, carriers and relevant service providers available at the time of quotation.

Rates may be adjusted in the following circumstances:

  • Shipping lines, airlines or carriers adjust their rates;
  • Changes in fuel, peak-season or other international surcharges;
  • Changes in cargo details, weight, dimensions, quantity or delivery terms;
  • Changes in routing or schedule;
  • Additional services outside the quoted scope.

Additional charges may include, but are not limited to: THC, Documentation Fee, Port Charges, Terminal Charges, Congestion Surcharge, Peak Season Surcharge (PSS), Emergency Risk Surcharge, Fuel Surcharge, Overweight Charge, Security Fee, Carrier Adjustment Factor and other charges imposed by carriers or competent authorities.

Booking and Space Availability

Booking confirmation is subject to:

  • Carrier space availability;
  • Container and equipment availability;
  • Vessel or flight schedules;
  • Carrier requirements and regulations.

AMI's issuance of a booking confirmation does not constitute a guarantee by the carrier that the schedule will remain unchanged.

Transit Time

Any Transit Time, ETA, ETD, routing or mode of transport provided is indicative only.

AMI does not guarantee that the cargo will:

  • Depart according to the original schedule;
  • Arrive by the stated ETA;
  • Move via the originally indicated routing.

During transportation, the carrier may change vessel or flight schedules, transshipment ports, routing or mode of transport. AMI will update the Customer with the latest information upon receipt of notice from the carrier.

Services Not Included

Unless otherwise agreed in writing or expressly stated in the quotation, the quotation does not include:

  • Cargo insurance;
  • Government taxes, duties and charges;
  • Container storage, yard or warehouse storage, Demurrage and Detention;
  • Customs inspection, quarantine, specialized inspection and fumigation;
  • Additional X-Ray screening or manual inspection;
  • Packing, crating, palletizing or cargo reinforcement;
  • Forklift, crane or lift-gate services;
  • Handling outside business hours, on weekends or public holidays;
  • Dangerous Goods (DG), lithium batteries, reefer cargo, OOG, overweight, prohibited or special cargo.

Cargo Packaging

The Customer is responsible for ensuring that the cargo is packed appropriately and is suitable for international transportation.

AMI reserves the right to refuse cargo or request repacking where the cargo may create safety risks, become damaged or affect other cargo.

For Dangerous Goods, lithium batteries, chemicals or other specially regulated cargo, the Customer must make a full declaration before tendering the cargo.

AMI inspects only the apparent external condition of packages upon receipt and shall not be responsible for internal damage where the external packaging remains intact.

Customer Responsibilities

The Customer is responsible for:

  • The legality of the cargo;
  • The accuracy of all documents;
  • Accurate declaration of commodity name, weight, quantity, value, origin, HS Code (if available) and cargo characteristics.

The Customer shall indemnify AMI for reasonable costs, penalties or losses arising from incorrect declarations, inaccurate or missing documents, consignee refusal to take delivery, or special handling required by competent authorities.

Force Majeure

AMI shall not be liable for loss or delay arising from events beyond its reasonable control, including but not limited to:

  • Natural disasters, war, strikes, riots, terrorism or epidemics/pandemics;
  • Lockdowns, quarantine or changes in government policies;
  • Decisions or actions of competent authorities;
  • System failures or other force majeure events.

Limitation of Liability

Where a loss is determined to have resulted entirely from AMI's direct fault, AMI shall be responsible for the resulting costs within the value of the services provided by AMI or subject to the applicable liability limits under standard trading conditions, international conventions or laws governing the relevant mode of transport.

AMI shall not be liable for:

  • Indirect or consequential loss, loss of profit, loss of revenue or loss of business opportunity;
  • Business or production interruption or consequential losses;
  • Losses arising from carriers, ports, airports, warehouses or competent authorities.

Confidentiality and Compliance

AMI undertakes to keep the Customer's information, documents and data confidential in accordance with applicable law.

AMI reserves the right to refuse services for cargo that violates applicable law, is prohibited from transportation, or does not comply with the requirements of competent authorities or carriers.

Acceptance of Services

By confirming the quotation, submitting a booking or Shipping Instruction (SI), tendering cargo, authorizing AMI to perform services, or otherwise using any AMI service, the Customer is deemed to have read, understood and agreed to these Terms & Conditions.

These Terms & Conditions form an integral part of the Service Quotation and supersede any previous terms or quotations relating to the same scope of services, unless otherwise agreed by the parties in writing.
